The hand-held wireless communication device charge covers any touching, holding, or using a hand-held wireless communication device (cell phone or tablet), for any reason other than to call 911, at any time while on the road in your vehicle—this includes while stopped at a red light. The penalties for a hand-held device charge in Ontario are as follows:
First Conviction
- A fine of $615, if settle out of court
- A fine of up to $1000 if case taken to court
- 3 demerit points
- 3-day licence suspension
Second Conviction
- A fine of $615, if settle out of court
- A fine of up to $2000 if case taken to court
- 6 demerit points
- 7-day licence suspension
Third Conviction
- A fine of $615, if settle out of court
- A fine of up to $3000 if case taken to court
- 6 demerit points
- 30-day licence suspension
